This essay discusses why the circumstances and the reason for the commitment of a crime must be taken into account while declaring a decision. Also, provide the reason for the fixed punishment failure. The fixed sentence for each felon is equivalent to all the crimes are equal whatever it is either a traffic rule break or a murder. For example, a small street thief will also be equal to a rapist and he/she will get a sentence to death. This can be an obvious bias with a person who committed a minor crime by mistake or unintentionally. Moreover, it might motivate people to commit terrific crimes. In such a system, a person who breaks the traffic law would be inspired to kill his enemy because, in the end, he will get the same decision. Therefore, fixed punishment would never work in terms of crime for any country. On the other hand, the circumstances in which a crime happened and the inspiration behind the fact of crime must be given a priority while making a decision. For instance, an unintentional or accidental crime should have lower seriousness rather than a planned one. Likewise, the situation of a person whether he/she was motivated by the enemy or not should also be accounted for. To add more, sometimes people become a passive member in the crime such as give money to a professional killer to do their task. In such cases, both are equal and must be given the same sentence irrespective of their dignity in the community. In conclusion, I think that instead of being equal for all the felons and declare the same result for everyone, a thorough analysis of the status of affairs of individuals, motivation which made such situation and the membership of each and every person connected with it must be done prior to declaring any result. At last, it’s the decision about someone’s life.
