Vietnam is a civil law country because the Vietnamese legal system is mainly influenced by Communist legal theory and French civil law and uses statutory law mainly; the judge plays an active role during a trial; the judge is actively involved in investigating the facts of the case (inquisitorial system); lawyers are only conducted litigation; the capacity of judges is still limited to build law sources from case law.
